            Protest Decision 2017 ESD 383 was issued on February 15, 2017.  On February 17, 2017, Fred Zuckerman filed an appeal of ESD 383.  By Notice of Hearing sent to all identified Interested Parties, a telephonic hearing was scheduled for March 3, 2017.   On February 27, 2017, the Election Supervisor submitted a written response to the appeal.  The Election Appeals Master also received pre-hearing submissions from Mr. Zuckerman, the Hoffa Campaign, IBT, and TDU.  A telephonic hearing on the appeal was held on March 3, 2017, during which the Election Appeals Master heard argument on behalf of the Election Supervisor, Mr. Zuckerman, the Hoffa Campaign, IBT and TDU.

            On March 6, 2017, the Protestor submitted in writing a request to withdraw his appeal.  The Election Supervisor requests that the Election Appeals Master decide the appeal by affirming the Election Supervisor’s decision in ESD 383. 

The request to withdraw the appeal is hereby GRANTED, and the appeal is deemed WITHDRAWN, with the understanding that the Election Appeals Master may consider representations made in oral argument by Interested Parties during the March 3 hearing in connection with the pending appeals of ESD 378 and ESD 386.
